Please read these Terms and Conditions of Use carefully. Use of this Site constitutes acceptance of these Terms in accordance with Chapter 3, Section 11 of the Electronic Communications and Transactions Act 25 of 2002.

  • By accessing or using this Site, you agree to be bound by the most current version of these Terms and Conditions posted at the time of use.
  • These Terms are legally binding and enforceable against you under South African law.

We hold an off-consumption liquor licence WCP/041872 issued under the Western Cape Liquor Act. This Service enables the online ordering and purchase of wine and related products for off-consumption only.

Your access to and use of the Service is conditional upon acceptance of these Terms, our Privacy Policy, and all applicable laws. If you do not agree, you may not use the Service.

Age Restriction and Alcohol Sales

  • You must be 18 years of age or older to purchase alcohol.
  • You warrant that you and the recipient are legally entitled to receive liquor.
  • Valid photo identification may be required upon delivery or collection.

We reserve the right to refuse orders, cancel transactions, or decline delivery where age verification cannot be satisfactorily completed or liquor laws are not met.

Drink responsibly. Alcohol abuse is dangerous to your health. Not for sale to persons under the age of 18.

Purchases

To make a purchase, you may be required to provide personal and payment information. You warrant that you are legally entitled to use the payment method provided and that all information supplied is accurate and complete.

Prices are in South African Rand (ZAR), inclusive of VAT where applicable, and exclude delivery fees unless stated otherwise. We reserve the right to correct errors, cancel orders, or issue refunds where necessary.

Delivery, Risk, and Performance

Delivery details are displayed during checkout. Delivery times are estimates only. Risk and ownership pass to you upon delivery to the confirmed address.

If we cannot perform within 30 days (or agreed timeframe) per ECTA section 46, you may cancel the transaction with a full refund.

Cooling-Off, Returns, Refunds, and Cancellations

Under ECTA section 44, you may cancel an electronic transaction within 7 days of receipt of goods, subject to return conditions.

Alcohol products may have limited return rights due to their perishable nature. Please refer to our Returns and Refunds Policy for full details.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

Intellectual Property

All content on the Service remains the exclusive property of Appelsdrift Farm (Pty) Ltd and is protected by copyright and trademark laws.

We are not responsible for third-party websites or their content or privacy practices.

Limitation of Liability and Disclaimer

The Service is provided “as is” and “as available”, subject always to the Consumer Protection Act 68 of 2008.

Nothing in these Terms limits liability that cannot lawfully be excluded under South African law.

Termination

We may suspend or terminate access for breach of these Terms. Termination does not affect statutory rights.

Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. South African courts have exclusive jurisdiction.

We may amend these Terms from time to time. Continued use of the Service constitutes acceptance of any updates.
